INFORMATION REGARDING THE PROTECTION OF PERSONAL DATA This information is provided pursuant to Article 13 of Regulation 2O16/679/EU (hereinafter, for brevity, the “Regulation”) and Article 13 of Legislative Decree 3O June 2OO3, no. 196 (hereinafter, for brevity, also “Privacy Code”), as amended by Legislative Decree 101/2018, by Pre Gel S.p.A., in its capacity as Data Controller. Your data will be processed in the following ways and for the following purposes: NATURE OF PERSONAL DATA Processing will concern the personal data you have communicated by filling in the “data collection form” (EVENTUALLY TO BE REPLACED WITH THE NAME GIVEN ON THE FORM) and will be limited to those strictly pertinent and functional to the purposes pursued. PURPOSE OF PROCESSING The data provided are used for the sole purpose of:
• to send newsletters and e-mail communications for marketing, promotional, advertising and/or information purposes on products and news from the Pregel world;
• forwarding invitations to trade fairs, events and/or demos, possibly by means of direct telephone contact (including SMS and WhatsApp). ACCESS TO DATA Personal data may be made accessible for the purposes identified above: – to employees, collaborators and administrators of the Data Controller, in their capacity as persons authorised to process the data; – to third party companies or other subjects – for example: professional firms, consultants, etc.. – third party companies or other subjects – by way of example: professional studios, consultants, etc. – who carry out activities in outsourcing on behalf of the Data Controller, in their capacity as Data Processors. COMMUNICATION OF DATA The Data Controller may communicate your personal data to all those subjects to whom communication is obligatory by law. These subjects will process the data in their capacity as autonomous Data Controllers. DATA TRANSFER The data may be communicated to the Companies belonging to the Pre Gel Group, as well as to the Distributors of the Owner’s products, also based outside the European Union; the Owner assures as of now that the transfer of the data outside the EU will take place in compliance with the applicable legal provisions (art. 44 and ff. GDPR). LEGAL BASIS FOR PROCESSING The legal basis of the processing is the consent freely given, which may be revoked at any time (also through the opt-out system at the bottom of the e-mail communications you will receive). Processing carried out prior to revocation will remain valid. NATURE OF DATA CONFERMENT AND CONSEQUENCES OF REFUSAL The provision of data is optional, but refusal will make it impossible to obtain the services indicated above. METHODS OF DATA PROCESSING Personal data are stored in paper archives located at the Company’s headquarters and on servers located within the European Union. It remains in any case understood that the Owner, if necessary, shall have the right to move the servers and archives outside the EU. In this case, Pre Gel assures as of now that the transfer of data outside the EU will take place in accordance with the applicable legal provisions. RIGHTS OF THE DATA SUBJECTS You may, at any time, exercise your rights: (a) to access your personal data; b) to obtain the rectification or erasure of the data or the restriction of the processing of the data concerning you; c) to object to the processing d) to data portability; (e) to withdraw consent: the withdrawal of consent shall not affect the lawfulness of the processing based on the consent given before the withdrawal; f) to lodge a complaint with the supervisory authority (Garante Privacy). All the above rights may be exercised by sending a request by e-mail to privacy@pregel.com. DURATION OF PROCESSING AND STORAGE PERIOD The personal data voluntarily provided by the interested party will be processed by the Data Controller and stored for a period of two years. Once this period has elapsed, the system will automatically send an e-mail to the interested party who, freely and according to his or her own will, may express his or her consent to the continuation of processing for the same period. Failure to renew consent to the processing of data will make it impossible to continue to obtain the above services.
